Court decision on suspension of newspaper issue "Vzglyad" came into effect

On February 08, 2013 The Judge of Board of Appeals of Civil Cases of Almaty City Court Raushan Adilbayeva has affirmed a court decision of Bostandyk Court of Almaty, dated December 20, 2012 on suspension of issue of the newspaper "Vzglyad" and its Internet-resources www.facebook.com/vzglyad.kz, www.respublika-kz.info/vzglyad within territory of Kazakhstan. The private claim of editorial workers has been dismissed.

We would remind you that the district court has issued the ruling by suit of Public Prosecutor of Almaty on closure of forty printed and Internet-media, including newspaper "Vzglyad". The General Prosecutor's Office has considered that the edition propagandized extremism. In his suit, Public Prosecutor referred to expert report of judicial psychology and philological expertise which was conducted by experts of the Regional Scientific and Production Laboratory (Almaty) of Ministry of Justice of the Republic of Kazakhstan in connection with "Kozlov's case".

During a trial lawyers of the newspaper G. Nam and A. Shormanbayev explained to court that General Prosecutor's Office did not give proof of guilt of the newspaper and could not prove the presence of publication of the extremist character.

While, experts of Public Center of Expertise over Information Disputes under International Foundation for Protection of Freedom of Speech "Adil Soz" they have conducted politological and linguistic report did not see statements of extremist character in publications.

Editorial staff intended to appeal against judg(e)ments of courts, concerning closure in Supreme Court and Committee for Human Rights of the United Nations.
