Uralsk City Court has withheld newspaper "Uralskaya Nedelya" and journalist Lukpan Akhmedyarov payment in installment of moral damage

Judge of Uralsk City Court № 2 Aysha Irgalieva withheld newspaper "Uralskaya Nedelya" and journalist Lukpan Akhmedyarov payment in installment of KZT 20000000 (USD13605) as moral damage to JSC "Tengizneftstroy".
The charges stemmed from article “For the cover of tender” by L. Akhmedyarov, which was published in the newspaper “Uralskaya Nedelya” on August 06, 2009. JSC “Tengizneftstroy” has begun construction on place of prospective gas – transmission pipeline “Zhympity – Karatuba” before summarizing. Servicemen of JSC “Tengizneftstroy” have been sure in their victory on the tender. Some months ago they won the tender and brought a suit against newspaper "Uralskaya Nedelya" and journalist Lukpan Akhmedyarov.
The newspaper "Uralskaya Nedelya" and journalist Lukpan Akhmedyarov should recover KZT 20000000 (USD13605) as moral damage in solidary order to JSC "Tengizneftstroy" according to the decision of Uralsk City Court № 2 on April 19, 2010.
Weekly independent newspaper “Uralskaya Nedelya” (West Kazakhstan) has announced about campaign “Action of Trust”. Readers of the newspaper proposed the idea and title of action. They began fund-raising for lending support to the exclusive, independent edition in West Kazakhstan. They could collect only KZT 1.7 millions per month.
Editorial staff of the newspaper "Uralskaya Nedelya" and journalist Lukpan Akhmedyarov have addressed to Uralsk City Court № 2. They proposed to pay KZT300000 (USD2040) monthly. However, the court has made a decision about pay off debt KZT10000000 (USD68027) from each defendant.
Editorial staff of the newspaper "Uralskaya Nedelya" and journalist Lukpan Akhmedyarov had no KZT20000000 (USD13605) as immediate compensation. As a result of it newspaper "Uralskaya Nedelya" will be closed and Lukpan Akhmedyarov will be instituted to criminal responsibility for malicious failure of court decision.
