Appellate Court Upholds Media Rights: Atyrau Regional Court Declares Publication of Murderer's Photo Lawful

This case, or rather a series of cases, should be compiled into a teaching case for law faculty curricula and included in lectures on journalism law. In April 2023, the Constitutional Court ruled that media outlets have the constitutional right to publish photographs of individuals without their consent if the publication is conducted to protect the constitutional order, maintain public safety, safeguard human rights and freedoms, or preserve public health and morality.

Journalists' Lawsuit Against the Ministry of Culture and Information Proceeds to Closing Arguments

Today, 4 November, the Inter-District Civil Court of Astana held closing arguments in the collective lawsuit filed by nine journalists against the Ministry of Culture and Information and the Ministry of Justice. The journalists are challenging several provisions of a new order that establishes the "Model Rules for Accrediting Journalists", arguing that these provisions are restrictive and unconstitutional.

Several Questions after the First Court Hearing on the Annulment of Standard Media Accreditation Rules

On October 31, the first hearing took place in the Inter-District Civil Court of Astana regarding a collective lawsuit filed by nine journalists against the Ministry of Culture and Information of Kazakhstan. The lawsuit challenges the provisions of a new order, which prohibits accredited journalists from disseminating information received from government agencies through any media outlet other than the one that accredited them.

However, instead of providing clear and direct responses to the journalists' concerns, the defendants' position only raised further questions.

PRESS RELEASE: Journalists Challenge Standard Rules for Accreditation in Civil Court

The Interdistrict Civil Court of Astana accepted a collective lawsuit on October 7 from nine Kazakhstan journalists against the Ministry of Culture and Information, challenging provisions of the new order that establishes "Standard Rules for Journalist Accreditation". The plaintiffs argue that this regulatory legal act seriously violates their constitutional rights to freedom of speech and information dissemination.
