Editorial staff of newspaper “Respublika” could not make recovery of moral damage to “BTA Bank” by judgment

Medeu District Court of Almaty has dismissed claim of the editorial staff of newspaper “Respublika” on March 01, 2010. It was connected with the ruling of Medeu District Department of Administrator of Courts of Almaty. This ruling was signed by Law Officer Makhmud Sadykov. It was impossible distribution of the newspaper “Respublika – Delovoye Obozrenie”. Judge Zhanna Altayeva took into her account arguments of the parties. She has made a decision that actions of law officer have been legal and based on law “On Law Officers”.
Lawyer of the newspaper “Respublika” Sergey Utkin said that law officer violated article 14 of law “On Mass Media”, but the court has dismissed it. The newspaper could be published, but it could not be disseminated by new judgment.
On February 22, 2010 M. Sadykov addressed to Medeu District Court of Almaty. It has issued a ruling. Printing houses should transfer all funds, provided for publication of the newspaper “Respublika – Delovoe Obozrenie” to account of Administrator of Courts of Almaty. They could do it to the prejudice of themselves.
It was impossible to fulfill judgment dated on September 09, 2009, concerning recovery of 60000000 tenge (40816 USD) as moral damage. Editorial staff had not any property and could not pay their debt after distribution of the newspaper.
Court officers asked journalists to show their identification certificates for making of copies. They placed them in the minutes of trial as participants of it. Sergey Utkin said that it was illegal.
