of journalistic community of the Republic of Kazakhstan

 

on inadmissibility of censorship distribution and restriction of freedom of speech

 

Freedom of speech, proclaimed by Constitution of the Republic of Kazakhstan as inalienable human rights was violated by ruling of Medeu District Court of Almaty on February 01, 2010. It was impossible to make publication of critical materials about activity of Deputy for Chairman of Board of Foundation “Samruk-Kazyna”, Chairman of Board of Directors of National Company “KazMunayGaz”, son-in-law Timur Kulebayev. Judge D. Makhmanova made censorship actually and pressured upon popular independent editions.

There was seizure and confiscation of newspapers “Svoboda slova”, “Golos Respubliki” and “Vzglyad” and other ones. Law officers referred to court order of Medeu District Court of Almaty, took editions from selling only for mention of surname Kulibayev. Director of Printing House “Vremya-Print” Elena Burmistrova was brought to trial. Her printing house made next issue of the newspaper “Svoboda slova” according to contract.

On February 09, 2010 Judge D. Makhmetova reversed her ruling at the legal proceeding. As a result of it there were features of censorship and repressive measures against independent media outlets in the country. She found out that the plaintiff did not make pre-trial order of dispute solution and dismissed suit of T. Kulibayev. Who could grant guarantees that such actions will not be made in the future?

Opposition media outlets did not charge T. Kulibayev with corruption actions or commitment of other crimes. They made their professional duty, informing the society about his activity on territory of the Republic of Kazakhstan. Media outlets of the Republic of Kazakhstan covered investigative process. Making pressure upon mass media (it meant legal proceedings and arrests) has been a step for illegal action and corruption. It has been as outrage upon Constitution of the Republic of Kazakhstan.

They demanded General Prosecutor’s Office, Supreme Court, and President of the Republic of Kazakhstan to deter anti-constitutional attempts of censorship and restrictions of freedom of speech.

They asked OSCE in Europe to give principal estimation of situation of freedom of expression in the country, which has been Chairman of OSCE in Europe.
