Convicted editor of newspaper “Alma-ata Info” Ramazan Yesergepov was conveyed to standard regime penal colony

On December 16, 2009 Chief Editor of the newspaper “Alma-ata Info” Ramazan Yesergepov was conveyed from investigatory isolation ward to standard regime penal colony of Taraz.
Criminal case was brought against Ramazan Yesergepov in January 2009.Yesrgepov was found guilty under articles 172 p.1 and 339 p.2 of Criminal Code of the Republic of Kazakhstan. He was sentenced to three years of imprisonment in standard regime penal colony in January 2009. Yesergepov could not make editorial activity during two years after his imprisonment. Court of Appeal Instance left the sentence standing.
The charges stemmed from article “Who does rule country- President or CNS?” by Ramazan Yesergepov, published in the newspaper “Alma-ata Info” on November 21, 2008. There was publication of the letter of Head of Zhambyl Regional Department of Committee of National Security to Chairman of CNS Amangeldy Shabdarbayev. There was an opening of criminal case against company “Taraz” and founder of company Sultan Makhmadov has tried to meet with President of Kazakhstan Nursultan Nazarbayev with goal to influence on investigative process.
On August 08, 2009 court №2 of Taraz took incriminated charges of Ramazan Yesergepov as proved ones and committed him to three years of imprisonment in standard regime penal colony. He can not make editorial activity during two years after his imprisonment. Court of Appeal Instance left the sentence standing. It was close legal proceeding. The sentence was passed in spite of article 19 of Criminal Procedural Code of the Republic of Kazakhstan. Human rights activists and journalists made a statement, concerning groundless and illegal charges and violations of Yesergepov’s rights during investigative process and legal proceeding.
Ramazan Yesergepov could be transferred to colony-settlement on October 05, 2009. But his petition and Raushan Yesergepova was dismissed. There was a reason that Ramazan Yesergepov did not mend his way. Ramazan Yesergepov had no any remarks in written and oral form.
