Proposals of state regulation of access to Internet do not meet to international standards of OSCE

There was a round table “State regulation of access to Internet and right of citizens for getting of information” on April 09, 2009 in Astana. It was implemented by Centre of OSCE in Astana, Agency of Information and Communication of the Republic of Kazakhstan, Public Organization Freedom House, and International Foundation for Protection of Freedom of Speech “Adil soz” and Union of Journalists of Kazakhstan.

Representative Officers of Ministry of Culture and Information, Ministry of Internal Affairs, Committee of National Security, Public Prosecutor’s Office, Supreme Court; Deputies of Majilis of Parliament of the Republic of Kazakhstan, employees of NGO’s and journalistic community have taken participation in round table.

There was discussion of law “On Introductions and Additions into Some Legislative Acts of the Republic of Kazakhstan of Information and Communication Networks”. Advisor of Representative of OSCE of Freedom of Mass Media Anna Karlsrayter has made a report. Experts have estimated this draft law critically.

It was said in recommendations of OSCE:

•        It is necessary to refuse from automatic distribution on all Internet-resources of mass media’s status and make concrete criterions, concerning position of Internet and mass media;

•        It is necessary to keep right of Internet-resource individual recognizance or non-recognizance itself as mass media;

•        Revoke of forms of mass media responsibility for violation of law, as stoppage and dissolution;

•        Repeal norms about prevention of access to foreign Internet-resources on the territory of Kazakhstan.

•        Make restoration of access to foreign mass media. Citizens must have right for taking decision, concerning access and subject for oversight in Internet.
