Proper correspondent of the newspaper “Vremya” Victor Miroshnichenko was found guilty of libel by sentence

There was a case by charge of libel of proper correspondent of the newspaper “Vremya” of North Kazakhstan region Victor Miroshnichenko in appeal court instance. Deputy for Chief of Department of Internal Affairs of North Kazakhstan region Sarsenbay Davletov has made a complaint.
On February 06, 2009 Petropavlovsk City Court of First Instance has passed sentence by this case. The judge Zholdasova has found journalist guilty under article 129 p.2 “Slander which is contained in a public speech, or in a publicly displayed work, or in mass information media” of Criminal Code of the Republic of Kazakhstan. Victor Miroshnichenko was punished by a fine in an amount from two hundred monthly assessment indices (it means 254 600 tenge). Editorial staff of the newspaper “Vremya” and Victor Miroshnichenko had to pay 100 000 tenge for policeman as damage in solidary order.
The charges stemmed from article “A protection racket for colonel”, published in the newspaper “Vremya” on July10, 2008. There was information on exactions among police officers in North Kazakhstan region.
A housewife has been one of the sources of information. She has refused from her testimony during legal proceeding and charged of the journalist of libel. Davletov has vouched for witnesses. They have confirmed information in the article of V. Miroshnichenko. However, court of first instance criminated.
V. Miroshnichenko has appealed from a judgment in above mentioned instance.
