Blogger and his wife convicted of defamation of a policeman in Magistau
On February 4, 2020, the Mangistau Regional Court began hearing the appeal of bloggers Zhambyl Kobeisinov and Dilbar Bezhanova against the verdict that found them guilty of defamation.
The married couple Zhambyl Kobeisinov and Dilbar Begzhanova made anonymous posts on YouTube “Mangistau baldness akіmіne” (“Appeal to the akim of the Mangistau region”), “102 natizhesi” (“Result of the call to 102” (emergency number)) and “Otirik povestka” Fake summons ”) using Kobeisinov's channel . The author tells about the actions of the police chief, that he beliees to be unlawful, illegal, in his opinion, and brutal committed by a group of unidentified persons who did not identify themselves but burst into the house on cars without identification marks, gave a fright to children, relatives, neighbours, used violence against his pregnant wife Dilbar Begzhanova, twisted his arms and bent his head down, dragged him into the car as if he were an severe offender.
”On December 13, 2019, the Munailinsk District Court of the Mangistau Region found Zhambyl Kobeisinov and his wife Dilbar Begzhanova guilty of an offense under Part 2 of Art. 130 of the Criminal Code of the Republic of Kazakhstan (Slander, committed in public or with the use of mass media or telecommunications networks).
Kobeisinov was sentenced to six months of imprisonment in a minimum security institution of the correctional system (penal colony settlement). His wife was sentenced to six months of restriction of liberty with probationary controls.
The defendants are acquitted of insult.
The convicts stated in the appeal that the first instance court did not hear the witnesses and did not take into account the fact that the police removed the video of the incident made by D. Begzhanova from her cell phone.
