A fine was imposed on editor of newspaper “Zhemkorlyk – Korlyk” Aset Assandi He was charged with slander

It has been known that, on June 20, 2016 Al-Farabi District Court (Shymkent) under the chairmanship of judge T. A. Kakharov has passed sentence to the editor of newspaper “Zhemkorlyk – Korlyk” (“Corruption Is Insult”), active user of Facebook Aset Assandi under articles 130 p. 3 («Slander») and 131 p.2 («Insult») of Criminal Code of the Republic of Kazakhstan upon a complaint of private charge Khanbibi Esenkarakyzy.

The charges originated from posts “Poet or…”, “Old men-bandits”, “Slash head, but not tongue” and etc. by Aset Assandi on his personal page Facebook from December 28, 2015 to January 02, 2016. Khanbibi Esenkarakyzy thought that there was misleading information which discredited her honour, dignity and business reputation, attended with accusation in corruption and insult.

The court has acquitted A. Assandi under article 131 p.2 «Insult» of Criminal Code of the Republic of Kazakhstan for absence of criminal elements in his actions. There were no signs of words and indecent word-expressions with regard to Kh. Esenkarakyzy. The court has found guilty A. Assandi under article 130 p.3 “Slander” of Criminal Code of the Republic of Kazakhstan, imposed him on payment of a fine in the amount of three hundred monthly calculation indices (KZT636300) and payment of cost of psychological and philological expertise in the amount of KZT26057.

Aset Assandi does not agree with accusatory part of sentence and he will appeal against judgment in the appellate instance.
