Court has recovered from newspaper “Tribuna” and its author KZT5000000

On July 12, 2016 Judge of Medeu District Court D. Makhmetova has passed judgment by suit of S. Syzdykov on recovery of moral damage for publication of unfaithful information. The suit was filed against SP “Kalam”, editor-in-chief of the newspaper “Tribuna. Sayasi Kalam” Zhanbolat Mamay and journalist Denis Krivosheev.

The judge D. Makhmetova has satisfied a claim partially. She imposed defendants on recovery of KZT5000000 as moral damage compensation and KZT50000 of state duty in solidarity. The plaintiff has demanded to make a denial and recovery of KZT15000000 as moral damage compensation.

The charges originated from publication, title and some fragments of article “Shall corrupt official head “AlmatyZharnama?” by Denis Krivosheev, dated 15 April, 2016. The plaintiff thought that there was publication of unfaithful information which discredited his honour and business reputation. Earlier, name of plaintiff was mentioned dozens of times in some media. It was connected with criminal case which was opened against S. Syzdykov by    Agency for Fighting Economic and Corruption Crimes. He was charged under article 176 “Appropriation or embezzlement of entrusted alien property” of Civil Code of the Republic of Kazakhstan.

Then, S. Syzdykov paid for damages in the amount of KZT23000000; the case was dismissed under the conciliation of parties.
