Almaty City Court has dismissed change of measure of restraint Seitkazy Matayev
“The court has found a rule of District Court №2 of Medeu District of bail hearing with regard to Seitkazy Matayev legal, ground in the form of house arrest. This court ruling was accepted on the same motives, that our defendant has violated obligation, in order to attend the agency of pretrial investigation”,- said Andrey Petrov on Thursday.
At the same time, Petrov noted, that he and lawyer Madina Bakieva they provided and submitted full package of documents, that their defendant regularly attended National Bureau of Anti-Corruption of Almaty and Astana; he was involved in all investigative actions, interrogations, face-to-face interrogations and introduction with documents”.
“But, we do not reasons, that court finds fact of violation of obligation of attendance», — adds A. Petrov.
“Today, this rule fails to be appealed and respectively when two months are expired there will be a question of dismissal of extension of preventive measure, we shall again file a motion of bail hearing. Itdependsonchangeofcircumstances.
In her turn, lawyer of S. Matayev Madina Bakieva noted, that court took into account only arguments of National Bureau of Anti-Corruption, but not documented arguments of his lawyers. S. Matatev has attended all investigative actions.
She reminded, that 22 February, 2016 S. Matayev informed in written form investigative bodies, that his lawyers had beenon lawsuit in Astana and that’s why he asked to adjourn this investigative action.
“But, Seitkazy Matayev was delivered to the building of National Bureau of Anti-Corruption compulsory in violation of norms of Criminal Procedural Code and with violation of right for protection, he was detained under article 128 of Criminal Procedural Code of the Republic of Kazakhstan”- adds M.
