Trial of Julia Kozlova: Chronicle of Events
There was a continuation of lawsuit towards criminal case with regard to journalist of information portal Nakanune.kz Julia Kozlova, who was charged under article 296 p. 2 "illegal manufacture, processing, purchase, storage, transportation, transfer or sale of narcotic drugs or psychotropic substances and their precursors" of Criminal Code of the Republic of Kazakhstan" in Bostandyk District Court № 2 (Almaty) on February 18, 2016.
First of all, one of the witnesses Dauren Dabylov was examined; he was delivered to the court by force, because Dabylov did not attended lawsuit. His examination has been extreme important, because defense team has found his profile in one of the social networks, where Academy of Ministry of Internal Affairs of the Republic of Kazakhstan was mentioned and also, his photos in uniform of police cadet with pistol in his hands. During last lawsuit, lawyer Aiman Umarova demonstrated these photos. Dabylov acknowledged, that he really has been police cadet of the Academy of Ministry of Internal Affairs of the Republic of Kazakhstan during six months. Then, he expelled by his own wish. The most interesting detail, his witnesses evidences varied with evidences of the second witness.
Julia Kozlova has witnessed in court, she disagreed fully with charges brought against her.
Then, court has examined investigative officer Tolaganay Erzhanova, who made a search of flat of Julia Kozlova on December 18, 2015 within the scope of pre-trial investigation under article 274 "distribution of misleading information" of Criminal Code of the Republic of Kazakhstan which was launched upon a suit of JSC "KAZKOMMERTSBANK".Tolaganay Erzhanova answered in monosyllbles on some questions of lawyer (in particularly, "I do not remember"). But, she acknowledged, that order to conduct forensic medical examination of Julia and her sister Elena subjected to content of drugs in organism, before this moment, when she knew, that vegetable matter which was found in the kitchen, it was a drug. She has also, insisted, that Julia and Elena Kozlov's voluntarily have gone to the Department of Internal Affairs (Almaty), they were forced to it. In words of Julia, Tolganay Erzhanova said to her about taking into custody. She has also, insisted, that Julia and Elena Kozlov's decided to undergo forensic medical examination voluntarily. There was no any confirmation of this in case materials, rather on the contrary.
The operative police officer Nurakynov was examined; he together with three police officers delivered first of all, Elena Kozlova and then, her sister Julia to the emergency hospital for medical examination forcibly. It is, according to case materials. Nurakynov stated, that he was empowered to take results of examination; delivered none forcibly. He answered on all questions "I do not remember", but judge L.M. Bektemirova admonished him.
It is important that, trial began at 15.30 p.m. and it ended at 21.20 p.m. On Monday 22 February, 2016 trial will be continued at 10.00 p.m.
We would like to remind you that except that, Julia Kozlova as her colleagues of Nakanune.kz, had been as status of witness, who had right for protection of criminal case under article 274 p.3 of Criminal Code of the Republic of Kazakhstan. The editor of portal Guzyal Baidalinova had been as suspected person at the same case; she had been in pretrial detention facility. On February 15, 2016 her arrest was enlarged before 23rd March, 2016. At this day, according to rule of investigating judge; property was seized. This property was proposed as pledge under bail hearing on December 23, 2015. Thereat, seized property (flat) is not owned to Guzyal Baidalinova.
