Guzyal Baidalinova shall see the New Year in solitary confinement cell

The editor of Internet-portal Nakanune.kz and former employee of banned editions “Respublika” Guzyal Baidalinova, she was sent to the solitary confinement cell of Almaty; Guzyal Baidalinova shall be there two months during pre-trial investigation under article 274 p.3 “Dissemination of misleading information” of Criminal Code of the Republic of Kazakhstan. We would like to remind you that Guzyal Baidalinova was taken into custody during two months, a judge has fixed bail in the sum of 3000 monthly calculation indices, she could be released, if this bail would be paid. The day before, Executive Director of Public Foundation “Charter for Human Rights” Zhemis Turmagambetova and President of Public Foundation “Adil Soz” Tamara Kaleyeva, they sent their personal caution and answer for Guzyal Baidalinova to the investigative authority of Department of Internal Affairs (Almaty).

The judge has made a rule. The rule came into effect on December 29, 2015.  Neither relatives, nor lawyer of Guzyal Baidalinova Inessa Kisileva knew about her release. They knew, that Prosecutor’s Office probably, filed a protest. In the morning, December 30, 2015 lawyer Inessa Kisileva knew that Prosecutor’s Office protested bail still on December 28, 2015.

One more journalist Nakanune.kz Julia Kozlova is now as a witness, who has a right for protection. She is charged with dissemination of misleading information under article 274 p.3 of Criminal Code of the Republic of Kazakhstan; illegal manufacture, processing, purchase, storage, transportation, transfer or sale of narcotic drugs or psychotropic substances under article 296 p.2 of Criminal Code of the Republic of Kazakhstan.

We would like to remind you, that on December 18, 2015 editorial office of Internet-portal Nakanune.kz, flat of Guzyal Baidalinova and Julia Kozlova was searched. Experts “found” marijuana in tea in the kitchen of Kozlova and organism of Julia “contained narcotics”. Theindependentexpertshavedisprovedtheseconclusions.

The pre-trial investigation with regard to a person, who spread of misleading information, it was conducted by Department of Internal Affairs (Almaty) upon suit of JSC “KAZKOMMERTSBANK”. OSCE Representative on Freedom of the Media Dunja Mijatović has made a statement, concerning the recent detention of independent journalists and called on state authority of Kazakhstan to drop criminal prosecution with regard to them. If these measures were not taken, protection staff of Guzyal Baidalinova and Julia Kozlova would intend to launch a wide campaign among partners of bank under slogan “We do not cooperate with suppressors of freedom of speech”.
