Court decision on suspension of magazine became effective

The judicial bench of Almaty City Court has considered appeal towards rule of Specialized Interdistrict Administrative Court (Almaty), concerning suspension of magazine “ADAM” during three months. According to this rule of court of the first instance, owner of this edition LLP “ADAMDAR” has violated rules of re-registration, because it published magazine only, in Russian language, while two languages Kazakh and Russian languages were mentioned in the certificate of registration.  

 In particularly, complaint of LLP had following: “public servants of the Department of Internal Policy of Akimat (Regional Authority) of Almaty have missed the limitation periods; court which took aplace in a day of compilation of  administrative protocol, it violated right of journalists for protection.Norms of the Constitution have been violated. It has proclaimed freedom of creation and right for free choice of language of creation. According to norms of Constitution recitation of languages in certification of registration on what the printed matter had a tendency to be published.The printed matter had a right to be published on all languages, or on some mentioned languages voluntarily. None statutory acts has information, that magazines and newspapers should be published on all selected them languages simultaneously. The magazine is published in one language of two mentioned, it does not endanger public security.

 The judge Nurlan Kurmangaliev has upheld rule of administrative court after five-minute presence in chambers.  He has dismissed motion of LLP “ADAMDAR” of defendants, related to appeal to the Constitutional Council.  It was connected with official interpretation of article 19 p.2 of Constitution and explanation of official obligation of owner of media outlet to publish materials in Kazakh and Russian languages which were mentioned in certificate of registration of periodical printed matter.
