Prosecutor charged correspondent Ramziya Yunusova with slander

The Prosecutor of Shardarinsk District (South Kazakhstan Oblast) Talgat Seidualiev has charged correspondent of newspaper “Central Asia Monitor” Ramziya Yunusova with slander. Al-Farabi District Court of Shymkent has considered a case.  

The charges originated from article “Prosecutor’s millions” by Ramziya Yunusova which was published in newspaper “Central Asia Monitor” № 20 (544), on May 22, 2015. In her publicationRamziya Yunusova told about Talgat Seidualiev, who took out loan, he could not pay back loan and court’s decision bound him to pay the debt. Ramziya Yunusova was interested in situation around collection of money in order to pay back a loan rapidly. She thought that supervisory authorities should make a point of this situation.

Talgat Seidualiev in his complaint explained, that his wife,who took out a loan on mortgage in 2007 (she was engaged in sole proprietorship). He stated, thatRamziya Yunusova published deliberately untruth information on him which discredited his honour and dignity and charged her with slander under article 130 p.2 of Criminal Code of the Republic of Kazakhstan.        

In her turn,Ramziya Yunusova did not agree with charge with regard to her and asked court to acquit for absence of elements of crime in the act. The concrete facts of case were mentioned, they could be verified. The plaintiff failed to prove subjective aspect, criminal intent and motive, glaring falsehood of disseminated information.   

It is submitted that last trial will be held on August 31, 2015.
