Investigative officers of inquiry agencies intended to institute criminal proceedings against journalist Andrei Tsukanov for dissemination of misleading information

If investigative officers of inquiry agency shall establish a fact of his dissemination of misleading information, journalist of video portal«16/12»Andrei Tsukanovshall make himself liable to a fine up to five thousands of monthly calculation indicies, or shall be punished  with the deprivation of liberty for a period from two to five years.  

Now, Andrei Tsukanov isin his capacity as a witness, who entitles to protection, under criminal case which was opened under article 274 p.3 p.2 «Dissemination of misleading information information with the use of media information-communication networks” of Criminal Code of the Republic of Kazakhstan.   

On April 17, 2015 on his page in social network “Facebook”Andrei Tsukanov expressed and wrote his opinion about public person Kanagat Takeeva (http://goo.gl/2LV22T). 

Andrei Tsukanov expressed his opinion, that Kanagat Takeeva protect rights of persons somehow selectively, but she holds herself out as  defender of borrowers. In his commentsin proof of his statements, he published reference to coverage of eviction. Kanagat Takeevachallenged him, but she did not come. For it, a complaint was filed with police, that he disseminated misleading information and poached on somebody's preserves.    

He focused on reaction. On April 18, 2015, on Saturday he published reference to coverage of eviction and on the next day, Andrei was detained at 11.00. a.m. and sent to the Department of Internal Affairs, where he witnessed.  

The investigative officerAziz Hodzhaev served a notice at 17.00 p.m. on April 19, 2015. Andrei Tsukanov bought railway ticket to Astana at the same day with the dispatch at 18.00 p.m.;    Tsukanov noticed investigative officer, that he would not come and wrote him an undertaking to appear on any day after April 23, 2015.    

Andrei Tsukanov said, that he got on train policemen run andgot him off the train. He was sent again to the Department of Internal Affairs to investigative officer, but there was no any procedures and actions with regard to him. He had been there during an hour and a half and then Andrei was released. On the next day, Tsukanov was summoned at 12.00 a.m., but there was no any actions. Then, he called up at 19.00 p.m., there were also, face-to-face interrogations with Takeeva and complainant.
