LLP “Astana Agroproduct” demaned KZT5000000 from republican business weekly “Kursiv” for loss of benefit

LLP “Astana Agroproduct” filed a suit against online edition of   republican business weekly “Kursiv” about protection of honour, dignity, business reputation and recovery of inflicted damages.   

The charges originated from illustration for article “According to information of television channel “31 Channel” (Almaty) 136 samples of 150 of halal sausage had a porkmeat”  which was published on November 03, 2014. Human rights activists of public foundation     «Heritage of Ancestral Tradition” urged consumers not to have trust in products superscribed “Halal”. This article was illustrated by photo of sausage products of trade mark “Bakara”which was owned to LLP “Astana Agroproduct”.       

The plaintiff stated, that after publication with photo, they received claim letters from permanent customers, who stumbled at quality of halal production,thereby to suspend contractual relationships towards delivery of goods. As a result of it, loss of benefit in the amount of KZT5000000 (1USD=185.80) was inflicted on LLP “Astana Agroproduct”, especially, failure of consumer to deliver sausage products of trade mark “Bakara”.   

The plaintiff demanded, that court would impose LLP “Kursiv” on publication of a disclaimer of information which discredited business reputation of LLP“Astana Agroproduct” and recovery of KZT5000000 as compensation of moral damage.

The lawsuit was filed to Specialized Interdistrict Economic Court of Almaty. The trial will be held on April 22, 2015.
