KazTAG won trial on protection of honour dignity and business reputation

There was a final consideration of suit on protection of honour, dignity and business reputation which was filed by JSC  “Central Asian Electric Power Corporation” against news agency KazTAG in Specialized Interdistrict Economic Court of Almaty.

The charges originated from information “Mega Energy and Heating Companies of North Kazakhstan can be taken under the control of the Russian Federation” which was posted on some Internet-resources on October 06, 2014  with reference to news agency KazTAG. The one company from Russia admonished to dispose three enterprises which affiliated JSC  “Central Asian Electric Power Corporation”.

The plaintiff thought, that there was untruth information which discredited honour, dignity and business reputation, alleging his reason that JSC “Central Asian Electric Power Corporation” did not conduct negotiations, concerning disposal of its subsidiaries. Representatives of JSC “Central Asian Electric Power Corporation” have asked court to impose defendant on publication of disclaimer and post it on the website news agency KazTAG.

Servicemen of news agency disagreed with demands of representatives of energy company; they thought, that it was unlawful. During trial, representative of defendant lawyer of foundation “Adil Soz” Ganna Krasilnikova has pointed out, that this phrase could not be discredited, JSC “Central Asian Electric Power Corporation” did not give documentary evidence of disseminated information which had an impact on business reputation of company. There was only headline of disputable publication, but not text on the website of news agency KazTAG. As per the provisions of Civil Code of the Republic of Kazakhstan legal entities can not have such qualities as honour and dignity.  

On April 10, 2015 Specialized Interdistrict Economic Court of Almaty has dismissed suit of JSC  “Central Asian Electric Power Corporation” in full volume.
