Editor-in-chief of magazine “ADAM bol” Guljan Ergalieva has gone on indefinite hunger-strike
On January 19, 2015 Guljan Ergalieva has made an statement. There was a statement on beginning of indefinite hunger-strike. It was connected with imposition of arrest on all mixed property of director of LLP “ADAMDAR” (“PEOPLE”), who has been founder magazine and his wife. It was done, in order to execute judgment at the suit on compensation of moral damage of clergyman E. Amre. Guljan Ergalieva has stated, that it was major breach of operative rules of legislation, according to these rules, physical person has not been responsible for liabilities of legal entity.
The state power of Kazakhstan created the abnormal situation around magazine “ADAM bol” and its owner; it has gone beyond all bounds of law, common senseand transform intocynical and honest reprisal against our edition, infringement of the civil rights and abasement of human dignity of members of our editorial staff. Taking into account disregard of all letters and appeals of civil society, our pleas and calls on superior bodies to the illegal actions of inferiors and, also with the purpose of fighting for justice and law. I am as editor-in-chief of magazine, responsible for fate of our edition, interests of our readers and rights of our journalists; I go on indefinite hunger-strike not only as protest against official abuse, interfered by representatives of judicial and law enforcement system with regard to our edition and its managers; I think, that some requirements should be fulfilled by chief executives of relevant structures.
1. Prosecutor-General shall take effectual measures. It has to institute criminal proceedings against judge of Medeu District of Almaty A.N. Abisheva for blatant disregard of our rights during previous trials. You can introduce with details in our appeal which was addressed and sent to Prosecutor-General of the Republic of Kazakhstan on January 12, 2015.
2.City Court of Almatyshall hold new, normal, spacious and objective hearing of “ADAM bol” case. It is necessary to remdey breaches of our rights in court of first instance and launch a trial from the beginning proceeding from our unsatisfied motions and interrogation of all witnesses and specialists of this case.
3.Supreme Court of the Republic of Kazakhstan shall initiate supervisory procedure and direct Medeu District Court of Almaty to return the civil case, according to suit which was filed by Ersyn Amre against magazine “ADAM bol”; repeal decree of judicial chamber of Almaty City Court, dated 26 November, 2014 and leave decision standing of previous instance, concerning compensation and recovery of moral damage, dated 27 October, 2014.
4.Prosecutor's Office of Medeu District of Almatyshall institute officer of the court R. Nurseitov to official responsibility for excess of power and to criminal responsibility for illegal distraint of private propertyof some persons, who had no any obligations of legal entity during dispute towards compensation and recovery of moral damage.
