Publication of corruption offences it gave occasion to punish journalist

The charges originated from article "Innocent until proven guilty" about corruption offences of an official which was published in the newspaper "Vremya" ("Time") on June 19, 2014. The article was written and based on documents of pre-investigation check of financial policemen of Karaganda and solution of Disciplinary Council. In her article, journalist used some metaphors, plaintiff held them scorn. Aidar Telgarin demanded to remove an article from website of newspaper, publish a disclaimer, apologize to him and recover KZT5000000 (1USD=180.87) as compensation of moral damage.
The court concluded, that this article of defendants discredited honour, dignity and business reputation of Aidar Telgarin, who in the future would can indicate his willingness, in order to enter into civil service again or commercial entity, where prospective employer would have adverse opinion of him, based on this article. Aidar Telgarin had moral sufferings because of publication of misleading and dicrediting article towards him.
We would like to remind you, that legislation of Kazakhstan does not stipulate publication of remission in media, concerning cases over protection of honour, dignity and business reputation. Defendants intended to falsify a judgment in superior body.
