First trial on suit concerning closure of magazine "ADAM bol" failed to proceed further because of litigation

Defendants stated on the spot, that Acting Director of Department of Internal Policy under Akimat (District Administration) of Almaty A. Esenbekov (in particularly, he signed writ); he, according to his job title, had no any right, in order to file such lawsuits. They have also stated, that closure of magazine, prior to judgment, in order to secure a claim has been unjustified, because plaintiffs did not adduce evidences, that this article had calls on war. Representatives of akimat (district administration) could not response on question who had been interested in filing of this lawsuit.
The court has dismissed all filed motions of defendant. As a result of it, lawyers and defendants of magazine affirmed bias of judge A. Abisheva and they demanded challenge of a judge. The judge Musagaliev has considered this motion and he has dismissed it.
The judge said, that she would consider authority of plaintiffs and retire into chambers. Plaintiffs informed about their intention, in order to make an expertise of disputable text and defendants demanded, that they should provide some arguments and state concrete fragments of text have been calls on war. After that, both litigants asked recess. The next trial will be held on December 22, 2014.
