Journalist of newspaper "Balkhashskiy Rabochiy" Oksana Zhivitskaya was brought to trial for slander and insult

In her article Oksana Zhivitskaya wrote, that some inhabitants of microdistrict Shashubai addressed to the editorial office of newspaper "Balkhashskiy Rabochiy". Some of them asked to write about good results of activeness of housemates, the other ones asked to appease their neighbour. In describing of debaucher, Adil Agybaev learnt himself, even though journalist mentioned neither surname, nor name. This publication was written and based on complaint of neighbours and court decision on imposition of administrative liability for hooliganism with regard to tempermental neighbour.

Adil Agybaev has pointed out in his suit, his colleagues, friends and relatives recognized him in describing of hooligan; stated, that there was also publication of misleading information.

Commentary of foundation "Adil Soz":

We would like to remind you that, Criminal Code of the Republic of Kazakhstan in force, that slander contained in a public speech or in a publicly demonstrated production or mass-media, shall be punishable by a fine in the amount of 200 to 500 monthly calculation indices or by restriction of liberty for a term of up to two years. The Criminal Code of the Republic of Kazakhstan will be brought into force from January 01, 2015; it will allow to punish by a fine in the amount of 2000 monthly calculation indices or by restriction of liberty for a term of up to two years. Standing up for the norm, draftspersons of code stated, that upgrading of penalties in spite of decriminalization of slander (in particularly, it was demanded by civil society) had prophylactic purpose, but this article was used very seldom. It was 16th case of Oksana Zhivitskaya since the beginning of the year.
