Court of appeal has issued decree Editor of magazine "Anyz Adam" should recover compensation for moral damage to 13 veterans 100 000 KZT should be paid to everyone

On September 12, 2014 Court of Appeal of Almaty City Court which was presided by judge Nurlan Mukhamedzhanuly has partially changed judgment of Almalinsk District Court № 2 of Almaty which was awarded on June 30, 2014, according to suit of veterans of the Great Patriotic War which was filed against editor of magazine "Anyz Adam" ("Man of Legend") Zharylkap Kalybai. Court of appeal has reduced the amount of compensation of moral damage from KZT thirteen millions to KZT one million and three hundred thousand; KZT one hundred thousand should be paid to everyone.
We would like to remind you, that charges originated from issue of magazine "Anyz Adam" ("Man of Legend") which was published in April, 2014. The issue was devoted to the private and political life of Adolf Hitler, ambiguousness of intussusception of his figure involving some persons. The representative of plaintiffs Nurtas Akhmetov said earlier to the reporter of radio "Azattyk" ("Freedom") that issue of magazine "Anyz Adam" ("Man of Legend") which was published in April, 2014, it sang the praises of Adolf Hitler, like hero of his era. Veterans insisted on apology which editor-in-chief should make to Kazakh people and all veterans of the Great Patriotic War; they demaded recovery of compensation of KZT5000000 (1USD= 181.88) for moral damage to everyone and they asked, also to transfer this amount to account of Almaty City Branch of the Republican Public Association "Organization of Veterans".
It is worthy of note, that one of the plaintiffs, who attended appeal hearing he stated, that did not introduce with content of the scandalous issue of magazine "Anyz Adam" ("Man of Legend"), did not see it, prior to this trial, did not know about content of suit and did not delegate authority to lawyer Nurtas Akhmetov, in order to represent his interests in court. However, veteran explained, that he disagreed with praises of Adolf Hitler, because millions of people were victims of his attack.
Specialists-linguists made conclusions. They concluded, that analysis of ideological and thematical scope of magazine "Anyz Adam" ("Man of Legend")№ 8, 2014 and its conceptual trend was focused on presentation of achievement of personhood of the last fuehrer of Germany, demise of his ideas for all mankind.
Zharylkap Kalybai insisted to appeal decree of Board of Appeals.
