Suit in amount of KZT5000000 was brought against journalist of newspaper "Uralskaya Nedelya" ("Ural's Week")

The Deputy of Maslikhat (Local Representative Body) of West Kazakhstan Oblast Alibek Satbaev has filed a suit about protection of honour, dignity and business reputation against LLP "Zhurnalistkaya Initsiativa" journalist of the newspaper "Uralskaya Nedelya" ("Ural's Week") Talgat Umarov and lawyer Abzal Kuspanov.
The charges originated from article "Daughter in court, son in prosecutor's office" which was published in the newspaper "Uralskaya Nedelya" ("Ural's Week")on April 17, 2014. There was information on coverage of trial on case over theft of KZT15000000 (1USD=182.35) in Oblast Department of Land Relations. This article had the following words of lawyer Abzal Kuspanov of one of the accused persons, who said them during trial. The investigation made attempts, that main suspect Alibek Satbaev escaped liability because of his influential children who worked in court and prosecutor's office.
In his suit, Deputy of Maslikhat (Local Representative Body) of West Kazakhstan Oblast Alibek Satbaev noted: "All suspicions of my guilt feed upon words of lawyer Abzal Kuspanov and your
conclusions, but not upon materials of criminal case. But, this article is assertative and categorical; it has a serious negative impact on my honour, dignity and business reputation and also on honour and dignity of my children (it means daughter and son). He asked court to impose defendants on publication of disclaimer and recovery of KZT5000000 (1USD=182.35) as moral damage compensation".
Prior to bringing of suit, Alibek Satbaev asked editorial team of LLP "Zhurnalistkaya Initsiativa", in order to publish a disclaimer. But, editorial team has refused to publish a disclaimer on the ground that T. Umarov has cited only words of lawyer. Neither journalist, nor editorial team expressed their opinion or made conclusion. The opinion of deputy, concerning these utterances was published in the article. The editorial team of LLP "Zhurnalistkaya Initsiativa" in response for pre-trial complaint, proposed Alibek Satbaev to publish his response on their pages. But, he did not take the privilege of deputy.
