The editorial staff of newspaper "Megapolis" and one of the information sources should recover KZT16000000 (1USD=182.03) for publication of article "Where is our money?" in the newspaper "Megapolis" on December 30, 2013. The Court of First Instance, Saryarka District Court of Astana has passed judgment on March 31, 2014 at least.
One of the heroes of publication, Director of LLP "Business-Systems" Vadim Lopatin has told journalist, that former judge, now-existing lawyer Ayzhamal Babisheva won a lawsuit of KZT34000000, but money did not arrive in an account of LLP "Business-Systems".
Ayzhamal Babisheva did not provide information on flows of money in process of preparation of article, notwithstanding that journalists of editorial staff phoned her repeatedly; shortly after publication of article she has filed a suit about protection of honor, dignity and business reputation against newspaper "Megapolis", its owner V. Lopatin.
The court has considered two expertise of disputable text. One of them was made by a specialist of Center of Forensic Examination under Ministry of Justice of the Republic of Kazakhstan Dauren Rabilov, who thought, that this article had information which discredited the honor, dignity and business reputation of Ayzhamal Babisheva, but in truth he noted, if there was misleading information. The Public Center of Expertise over Information and Documentation Disputes of Foundation "Adil Soz" has made an alternative expertise. An expert did not find the discredited information in article.
Defendants expressed their disagreement, related to passed judgment and they would intended to falsify this judgment.
