Newspaper "Tribuna – Sayasat Alany" should recover KZT 2 000 000 as moral damage compensation

On March 18, 2014 Judge of Medeu District Court (Almaty) Galym Bekbatyr has passed judgment upon suit of the retiree colonel Kuspabay Zhampeisov which was filed against newspaper "Tribuna – Sayasat Alany". Editorial staff of the newspaper "Tribuna – Sayasat Alany" should recover KZT2000000 (1USD=182.04); it is tantamount to bankruptcy and shut down.

It was connected with interview which Zhampeisov gave to free-lance correspondent of the newspaper. The correspondent used words "What on earth is this? We have such mentality in order to dominate, plunder Kazakhstan's people and relish the opportunity" from direct speech of the interviewed Zhampeisov in the title "Mentality of our state authority – is domination, plundering of Kazakhstan's people, carpe diem".

After publication of article Zhampeisov demanded to publish a disclaimer and revision of quotation. In October 2013, editorial staff has fulfilled the demand of Zhampeisov in full force and effect; it did not hurt him to apply to court.

It was the second trial. In the morning after speeches of plaintiff and evidence, judge informed about debates of the parties during afternoon. The representative of plaintiff Sergey Utkin asked to adjourn the trial to other day, because he had hearing of the other case which was assigned previously in Almalinsk Court. But, judge said, that it was very important for him to complete consideration of case namely the present day. He promised to arrange about adjourning of a trial in Almalinsk Court; insisted on participation of S. Utkin in debates. The debates took a place at 16.00 p.m. The judgment should be passed at 18.00 p.m. During three minutes judge has read resolution part of a court decision and promised, that trial participants will receive judgment some of these days.
