Suit in amount of KZT500000 was filed against bloger Askar Shaygumarov

The former member of party "Alga" Rustam Abenov has filed a suit about protection of honour, dignity and recovery of KZT1000000 (1USD=182.10) as moral damage compensation to Uralsk City Court №2. The suit was filed against bloger, civil activist Askar Shaygumarov and former head of oblast branch of party "Alga" (Akmola) Marat Zhanuzakov. The charges originated from "Appeal to Minister of Justice of France", posted on Internet-resources www.ablyazov.org and in Facebook under title "For Support of M. Ablyazov and Inadmissibility of His Extradition to Russia". The appeal was signed by over 230 persons. Rustam Abenov said, that he was listed without knowledge and consent. Abenov called to Marat Zhanuzakov, in order to ascertain the accuracy of fact and requested to publish a disclaimer orally. Marat Zhanuzakov explained, that A. Shaygumarov collected signatures in West Kazakhstan Oblast.

None has contacted with R. Abenov after this conversation and his request about publication of a disclaimer was not fulfilled and suit was brought to court. Except for recovery of moral damage, plaintiff asked defendants, that they would make public apology to him and post a disclaimer of article on the website www.ablyazov.org.

A. Shaygumarov did not agree with charge with regard to him. He has not been either moderator and resource manager where materials were posted.

He has also filed a complaint to the Disciplinary-Qualification Board of Oblast Court (West Kazakhstan Oblast), chairman of court № 2 (Uralsk) and public prosecutor (West Kazakhstan Oblast) against judge G. Ospanova. He asked to take response measures with regard to judge and thought, that she entertained action illegally and made gross violations of norms of Civil and Procedural Code of the Republic of Kazakhstan.

The trial will be held on March 14, 2014.
