Board of Appeals has upheld ruling of court of first instance with regard to case on assassination attempt on journalist of newspaper "Uralskaya Nedelya" Lukpan Akhmedyarov

On August 21, 2013 Board of Appeals of West Kazakhstan Oblast Court has considered appeal of defendants and charge protest with regard to case on assassination attempt on journalist of newspaper "Uralskaya Nedelya" Lukpan Akhmedyarov.

Public Prosecutor's Office of West Kazakhstan Oblast has dissented from acquitting judgment of court of the first instance; it has acquitted the accused persons under article 235 "The Creation and Guidance of an Organised Criminal Group or Criminal Association (Criminal Organisation), and Participation in a Criminal Association" of Criminal Code of the Republic of Kazakhstan. The judgment in this part was not warranted by law.

The accused persons disagreed with passed sentence. In their appeals, Askhat Takhambetov, Mursalim Sultangereyev, Manarbek Akbulatov and Almaz Batyrkhairov have asked to reconsider the sentence of criminal court which convicted them in attempted homicide. Askhat Takhambetov, Mursalim Sultangereyev, Manarbek Akbulatov and Almaz Batyrkhairov have insisted, that they had no intention to kill journalist. They asked court to adjudge them guilty under article 103 "Deliberate Causation of Serious Damage to Health" of Criminal Code of the Republic of Kazakhstan and imposed the most mildest penalty for them.

Having examined arguments of the parties, Board of Appeals has upheld a sentence of court of the first instance with regard to performers of assassination attempt on journalist of newspaper "Uralskaya Nedelya" Lukpan Akhmedyarov.
