Court has dismissed suit of editorial staff of newspaper "Vremya" which was filed against Press Secretary of Almaty akimat (district administration)

On January 25, 2013 Judge of District Court № 2 of Almaly District (Almaty) Ayitzhanova has made a rule, concerning suit of editorial staff of newspaper "Vremya" which was filed against Press Secretary of Almaty Akimat (District Administration) Sergey Kuyanov.

The charges originated from "on-air interview" of press secretary for television channel "Almaty" on October 10, 2012. Sergey Kuyanov has expressed his opinion that in article "Who has a debt, we remit everyone" which was published in the newspaper "Vremya" on October 10, 2012; it misrepresented facts, concerning conference call with Prime Minister of the Republic of Kazakhstan S. Akhmetov and called a position of the newspaper "Vremya" as a position of "political prostitute".

The editorial staff of newspaper "Vremya" has applied to court. They demanded to recognize negative, offensive information, it had diminished and discredited business reputation of the newspaper "Vremya".

The judge has read expertise report of expert, philologist, associate professor R. Karymsakova. She said that the disputable phrase has been opinion in the form of implicit evaluative judgement, at the same time, linguostylistic and linguopragmatic analysis of phrase of S. Kuyanov acknowledged that there was a negative information with regard to editorial staff of the newspaper "Vremya". The court has dismissed lawsuit of the editorial staff of newspaper "Vremya" completely.

During trial editorial staff has filed a petition on special court ruling with regard to S. Kuyanov in connection with his breach of business ethic and norms of official behaviour. There was no information on it in court decision, judge did not even dismiss and grant petition.

Editorial staff informed about their intention to appeal against the judge's decision in Board of Appeals of City Court of Almaty.
