Issue of newspaper "Vzglyad" was suspended by court ruling

On December 20, 2012 Bostandyk District Court of Almaty under the chairmanship of judge Tatiana Chernysh has made a rule by suit of General Prosecutor's Office of Almaty which was filed against newspaper "Vzglyad" and its Internet-resources. The newspaper "Vzglyad" will suspend its publication, according to court ruling. The court ruling will come into effect in 15 days, on January 03, 2013.

The General Prosecutor's Office of Almaty did not furnish with proofs that newspaper "Vzglyad" spread extremism. Earlier, there were no any court rulings on recognition of it as extremist one.

It is worthy of note that during a trial owner of the newspaper "Vzglyad" was not brought to responsibility as plaintiff and defendant. The Representative of General Prosecutor's Office has referred to article 48 of Civil Procedural Code of the Republic of Kazakhstan which runs as follows that the organization could be brought to responsibility without foundation of legal entity. But, in certificate of registration, there was a mention of legal entity of the owner of newspaper, LLP "IAC Ayna".

The plaintiff (in particular, General Prosecutor's Office of Almaty) and judge have ignored this fact. The newspaper has become defendant.

The report of experts of philologist R. Karymsakova and political scientist Z. Karazhanov was heard, prior to reading of ruling at last trial. R. Karymsakova is one of the authors of method study of publications of incitement of different kinds of hostility and enmity. They did not find any signs of propaganda of extremism in studied materials.

Defendants intended to appeal this ruling in court of appeal.

We would remind you that on November 20, 2012 General Prosecutor's Office of Almaty has filed some claims to courts. It was connected with stoppage of issue and distribution of the newspaper "Vzglyad" and its dublicated Internet-resources. The General Prosecutor's Office of Almaty has informed that newspaper propagandized extremism. There were no any court rulings on recognizance of it as extremist one with regard to newspaper "Vzglyad".
