Court has imposed journalist Lukpan Akhmedyarov and newspaper “Uralskaya Nedelya” on recovery of KZT5000000 Tlekkabyl Imashev as moral damage compensation

On October 02, 2012 the Board of Appeals of West Kazakhstan Oblast Court has affirmed a judgment of Ural City Court, passed by suit of the Head of Oblast Department of Internal Policy Tlekkabyl Imashev who filed against journalist Lukpan Akhmedyarov and founder of the newspaper“Uralskaya Nedelya”, LLP “Journalistkaya Initsiativa”.

The charges originated from article “Brother, friend and cronyism” by L. Akhmedyarov which was published in the newspaper “Uralskaya Nedelya” on February 02, 2012. Akhmedyarov disclosed the family ties in oblast authority. Tlekkabyl Imashev was unsatisfied by words “Marriages are made in heaven, but the benefit is earth-bound from them. It confirmed his career growth of Tlekkabyl Imashev (in the past, he had been a teacher of physical culture; now, Imashev is a Head of Oblast Department of Internal Policy (West Kazakhstan Oblast)). Except for, his personal quality, he had ties of relationship with Imangali Tasmagambetov and Former Prime Minister of Kazakhstan”.

Tlekkabyl Imashev did not deny his relative ties, but he thought that their publication belittled his personal services. Tlekkabyl Imashev was abused by image to the material: "Reproduction of his image in the pack of playing cards abused him as state official, as citizen of the Republic of Kazakhhstan; they had a purpose to dicredit his reputation of the honest public servant and decent citizen".

There was a near-fatal attack on the eminent journalist Lukpan Akhmedyarov outside his home in the suburbs of the northwestern city of Uralsk on April 19, 2012. On April 22, 2012 Lukpan Akhmedyarov has recovered consciousness. He replied on issue of investigative officer, related to the publication, which has given rise to “intention to attempt homicide”. L. Akhmedyarov has called this article“Brother, friend and cronyism”.

In August, Lukpan Akhmedyarov was named 2012 winner of Peter Mackler Award.International Organization “Reporters Without Borders” awards this prize. The Peter Mackler Award is rewarded journalists, who report news in the country honestly, courageously, where freedom of the press is either not guaranteed or not recognized. The Officer of Department for Economic and Corruption-Related Crimes (West Kazakhstan Oblast) Arman Kozhakhmetov has filed a suit against Lukpan Akhmedyarov about protection of honor, dignity and business reputation to Uralsk City Court. He has demanded recovery of KZT3000000 as moral damage compensation from journalist L. Akhmedyarov and newspaper “Uralskaya Nedelya”.
