Court has made rule Lukpan Akhmedyarov and founder of newspaper "Uralskaya Nedelya" should recover KZT5000000 in favor of state official

On July 20, 2012 judge of court № 2 of Uralsk Batykgul Baymagambetova has made a rule. Journalist Lukpan Akhmedyarov and founder of the newspaper "Uralskaya Nedelya", they should recover KZT5000000 (1USD=149.51) in favor of the Head of Department of Internal Polivcy of West Kazakhstan Oblast Akimat (District Administration) Tlekkabyl Imashev.
The charges originated from article "Brother, father of the son-in-law and pull" by Lukpan Akhmedyarov, which was published in the newspaper "Uralskaya Nedelya" on February 02, 2012. There was information on ties on relationships in the government bodies of West Kazakhstan Oblast. The plaintiff was unsatisfied by following words:
"Marriages are made in heaven, but the benefit is ground from them. It confirmed his career growth of Tlekkabyl Imashev (in the past, he had been a teacher of physical culture; now, Imashev is a Head of Oblast Department of Internal Policy (West Kazakhstan Oblast)). Except for, his personal quality, he had ties of relationship with Imangali Tasmagambetov and Former Prime Minister of Kazakhstan".
Tlekkabyl Imashev was abused by image to the material: "Reproduction of his image in the pack of playing cards abused him as state official, as citizen of the Republic of Kazakhhstan; they had a purpose to dicredit his reputation of the honest public servant and upright citizen".
Forensic and linguistic expertise has concluded that the text of disputable article by L. Akhmedyarov, it had no signs, which discredited the honor and dignity of plaintiff. A specialist of Committee of Control for Quality of Medical Services has caught T. Imashev in a lie in the court. He/she has said about his hospitalization on the next day after publication of paper. The expert has given evidencies in the court. It was planned hospitalization; he stood in a queue for hospitalization during the ten days.
T. Imashev has filed a suit against journalist Lukpan Akhmedyarov and founder of the newspaper "Uralskaya Nedelya" on April 16, 2012. Three days later, L. Akhmedyarov was attacked. He was beaten, stabbed eight times and shot with a traumatic (non-lethal) weapon. On April 22, 2012 Lukpan has regained consciousness. Investigative officers attempted to find out the reason of attack on him. Lukpan Akhmedyarov believed that this attack on him was connected with his professional activity and it was caused by publication of the paper "Brother, father of the son-in-law and pull".
Earlier, the newspaper "Uralskaya Nedelya" has been on the verge of bankruptsy, according to rules of courts of West Kazakhstan. In 2010, plaintiff has dismissed a recovery of KZT20000000. In 2011, the same decision has been failed to execute; legal entities were debarred from recovery of moral damage, according to changes to Civil Code of the Republic of Kazakhstan.
