Editor in-chief of newspaper "Vzglyad" was detained and received into investigatory isolation ward

On January 23, 2012 security service officers of Department of KNB of the Republic of Kazakhstan have detained the editor-in-chief of the newspaper "Vzglyad" Igor Vinyavskiy; they have made also a search in editorial office of the newspaper "Vzglyad". The lawyer of I. Vinyavskiy said that his defendant was suspected in public exhortations for the forcible seizure of power, forcible retention of power, disruption of the safety of the state, or forcible changing of the constitutional order, as well as forcible disruption of the integrity of the Republic of Kazakhstan and the unity of its territory, as well as distribution of materials with such content for those purposes and the same acts committed with the use of the mass information media under article 170 of Criminal Code of the Republic of Kazakhstan. Vinyavsky is under investigation but has not been formally charged.

The journalist of weekly "Vzglyad" Olesya Schelkova said that security service officers of KNB confiscated all office equipment, including safes with documentation of accounting department and reporters' notebooks from the paper.

Now, editor-in-chief of the newspaper "Vzglyad" I. Vinyavskiy is in investigatory isolation ward of KNB of Almaty.

He was detained for three days.

There was a press conference on January 24, 2012 in Almaty. The independent lawyer Sergei Utkin appealing to criminal code, casted doubt on warrant detention of I. Vinyavskiy.

The Head of Foundation "Journalists In Trouble" Ramazan Esergepov (he was released on January 06, 2012) made assumption that the detention of I. Vinyavskiy has given a cause for followed arest. He said that the expertise of materials (they might be a cause for detention) have been already made; charge, concerning was framed up.

The Chairman of Union of Journalists of the Republic of Kazakhstan S. Matayev and President of International Foundation for Protection of Freedom of Speech "Adil Soz" T. Kaleyeva intended to make a public statement to General Prosecutor's Office. They asked to make known details of charge of I. Vinyavskiy, inform about the headlines of articles for conduction of independent expertise with participation of independent experts. Human rights defenders demanded to vary the preventive measure of journalist to recognizance not to leave.

An investigative and operative group of KNB of the Republic of Kazakhstan has opened a criminal case, related to facts of incitement of social enmity. Press Service of KNB informed about it.

"On January 06, 2012 the investigative and operative group of KNB of the Republic of Kazakhstan has opened a criminal case with regard to A. E. Amirova and other persons under article 164 p.3 ("Deliberate actions aimed at the incitement of social, national, tribal, racial, or religious enmity or antagonism, or at offense to the national honour and dignity, or religious feelings of citizens, as well as propaganda of exclusiveness, superiority, or inferiority of citizens based on their attitude towards religion, or their genetic or racial belonging, if these acts are committed publicly or with the use of the mass information media, the same acts committed by a group of persons or committed repeatedly, or combined with violence or a threat to apply it, as well as committed by a person with the use of his official position, or by the head of a public association and the acts stipulated by the first and second parts of this Article which entailed serious consequences") of Criminal Code of the Republic of Kazakhstan, according to press release, placed on the website of KNB on Tuesday. Public Prosecutor of Zhanaozen (Mangistau oblast) has sanctioned to make a search and conduct operative and search arrangements, related to place of residence and workplace of separate citizens, who lived in Almaty and Almaty oblast on January 23, 2012. There is an investigative process within scope of it, editor-in-chief of weekly "Vzglyad" I. Vinyavskiy was detained.
