Court has recovered KZT2000000 from newspaper "Svoboda Slova" its editor Eugene Rakhimzhanov and journalist Dilyaram Arkin

On January 13, 2012 Medeu District Court has delivered a judgment by suit about protection of honor, dignity and business reputation of the Former Chairman of Agency of Struggle for Economic and Corruption Crimes (Financial Police) of the Republic of Kazakhstan Sarybay Kalmurzayev to editor-in-chief of the newspaper "Svoboda Slova" Eugene Rakhimzhanov, journalist Dilyaram Arkin and owner of the edition (in particular, private foundation "Dunie" ).
The charges originated from articles "Destroyed logic" and "Red kingpin" by Dilyaram Arkin, which were published on March 03 and 10, 2011 in the newspaper "Svoboda Slova". Journalist has conducted the investigation of criminal case with regard to former high-rank officials of Ministry of Defense by fact of stealing of funds from state budget for acquisition of ultrasecret space intelligence technics.
S. Kalmurzayev has thought that there was a publication of untruth information, which discredited his honor and business reputation. In his suit he has asked defendants to publish the disclaimer, make an apology to him and recovery of KZT10000000 (1USD=148.20) as moral damage in solidary order.
Court has satisfied requests of plaintiff partially. The newspaper "Svoboda Slova" its editor Eugene Rakhimzhanov and journalist Dilyaram Arkin should recover KZT2000000 (1USD=148.20). The editor of the newspaper Eugene Rakhimzhanov and journalist Dilyaram Arkin should publish a disclaimer in "Svoboda Slova" and make an apology to him.
Defendants thought that the judgment has been politically motivated. They said about their intention to appeal it.
