Decision of court of first instance by suit of sanitary-epidemiologic station of Almaly district to LLP "Stan Prodaction" has been affirmed

On December 15, 2011 Cassational Board of Almaty City Court has affirmed the decision of Specialized Inter District Economic Court of Almaty about the suspension of activity of production studio of video portal "Stan" – LLP "Stan Prodaction" and its receiver and transmission equipment, before liquidation of violations, which were revealed by sanitary-epidemiologic specialists.
Earlier, in August specialists of sanitary-epidemiologic station of Almaly district have conducted casual control of receiver and transmission equipment and office of LLP "Stan Prodaction". They have made an conclusion, that electromagnetic radiation of receiver and transmission equipment failured to meet to sanitary norms (invited by servicemen of "Stаn Рrodaction" independent specialist did not agree to it). Servicemen of "Stаn Рrodaction" were punished by a fine in an amount up to twenty monthly assessment indicies (it meant KZT30240/1USD=148.27).
This conclusion has been the basis of suit of sanitary-epidemiologic station about the suspension of activity of production studio of video portal "Stan" – LLP "Stan Prodaction" and its receiver and transmission equipment. On September 27, 2011 Judge of Specialized Inter District Economic Court Mukhamedzhan Erzakov has satisfied a suit of specialists of sanitary-epidemiologic station. On October 26, 2011 Court of Appellate Jurisdiction of Almaty City Court has affirmed the judgement of Economic Court.
Representatives of "Stan Prodaction" disagreed with decision of Specialized Inter District Economic Court, but they executed it; office equipment has been changed and the contract of exploitation of receiver and transmission equipment with provider "ASTEL" has been dissolved, before session of board of appeals.
After that servicemen of production studio "Stan Prodaction" have addressed to sanitary-epidemiologic station of Almaly district. They asked to conduct a recontrol. But, SES' specialists did not either react on it.
Cassational Board has said that this matter should be solved in economic court. It was proposed on legal proceeding on December 15, 2011, related to complaint of defendant (there was no SES' control within two months). Servicemen of LLP "Stan Prodaction" should file an omission suit against SES. The Director of LLP "Stan Prodaction" Baurzhan Musirov has filed a suit against SES of Almaly District to Inter District Specialized Economic Court.
