Journalistic organizations have been dissatisfied by draft law "On Television and Radio Broadcasting"

Several non-governmental media organizations of the Republic of Kazakhstan have addressed to members of Parliament of the Republic of Kazakhstan, relating to draft law "On Television and Radio Broadcasting". They made an appeal.
The draft law "On Television and Radio Broadcasting" will be submitted to Majilis of Parliament in autumn of 2011. Ministry of Communication and Information of the Republic of Kazakhstan has drafted this document. Representatives of civil sector and media business took active participation in the activity of working group of the ministry. Due to joint actions some new progressive norms have been made for final document.
The most principal proposals of the society have not been entered into it. Some statements of draft law "On Television and Radio Broadcasting" consolidated monopoly position of the state on market of electronic media outlets. They had concrete conditions for violation of right of the society to free collection and distribution of information and damaged bases of enterpreneurship and principles of fair competition in the sphere of tele- and radio broadcasting.
Ministry of Communication and Information of the Republic of Kazakhstan failed to take the principle 50% to 50% (it meant the publicity and state structures) of the creation of Commission for Development of Television and Radio Broadcasting. It was proposed by representatives of civil sector. It has been fraught with replication of the protection and corruption during contest conduction for the inclusion of obligatory multiplex, or multiplex of free access.
Monopoly position and of national operator and out-of-competitive procurance of radio frequency militated against free creation and functioning of private operators.
Draftsmen have turned down the proposal of public associations, relating to the creation of private multiplexes with the help of acting television channels. Private television and radio channels will be depended on television and radio channels from wish of the operator-monopolist, concerning editorial policy and settlement of tarrifs.
The government of the Republic of Kazakhstan supported national producer, development of state language, keeping of rights of children and disabled persons; fulfilled obligations of television companies have not been based on assessment of proper capacities of national television market; had no a guarantee of state assistance. It wiil lead to conflicts, bankruptsy and closure of oblast television channels.
This draft law provided for the restriction of development of cable television by complicacy of contractual relationships of cable operators with foreign television companies.
It redeemed and complicated the registration of television channels as media outlets during disaffirmation of license.
There were no any measures of support during transfer of oblast private television channels to digital television channels and principles of maintenance of population by special receivers.
We ask deputies to include representatives of journalistic non-governmental organizations and media business in working group during consideration of this draft law. This draft law should be a powerful impulse for development of national television, according to order of President of the Republic of Kazakhstan N. A. Nazarbayev.
