Supreme Court has recognised illegal refusal to provide public important information for newspaper "Vecherniy Taldykorgan"

In spring, 2010 Head of State Office "Department of Education of Taldykorgan" B. Turusbekov has refused to provide the list of persons, who has been in turn to kindergarden for journalist of the newspaper "Vecherniy Taldykorgan" Zaure Zhotabayeva. It was done under pretence of protection of a child.
Chief Editor of the newspaper "Vecherniy Taldykorgan" Elena Burlutskaya and Zaure Zhotabayeva have addressed to Taldykorgan City Court for protection of their professional right to receive public important information. Court of First Instance has dismissed them. Court of Appelate Jurisdiction and Appeal Instance have abandoned their claims without satisfaction. Journalists have addressed to highest court.
Representatives of Supervisory Bar of Civil and Administrative Cases of Supreme Court of the Republic of Kazakhstan thought that this information did not violate rights of a child. It was directed to protection of social equity during allocation of seats within kindergarden. Supreme Court has recognized illegal actions of Head of State Office "Department of Education of Taldykorgan" B. Turusbekov. He should provide lists of persons, who has been in turn to kindergarden as of April, 2010 with date of filing of record from parents; enforce the payment of state duty.
