Claim was made against news agency "Kazakhstan Today" and public association "Union of Sport Journalists" for some millions

Director of National Coalition "Kazakhstan Smoke Free" Jamilya Sadykova, Public Foundation "Temekisiz" ("Smoke free") and Public Foundation "Center of Support and Promotion of Public Health Service" have brought a suit against news agency "Kazakhstan Today", editor-in-chief of the agency Timur Kuvatov and public association "Union of Sport Journalists".

The charges stemmed from article "Kazakhstan's journalists casted doubt on specific waste more KZT380000000 (USD2583054), which were contributed for anti-tabacoo campaign", which was placed on the website "Kazakhstan Today" (www.kt.kz) on November 18, 2010. The letter of public association "Union of Sport Journalists" was used in publication. It was about the financial activity of non-governmental organizations of the republic focused on struggle for tobacco smoking.

Plaintiffs have disagreed with untruth information in third and tenth lines of the text; insisted on publication of disclaimer, related to news of press agency "Kazakhstan Today" with material of constant retraction within a year, distributed among email recipients, removed the article from Internet. They have also asked the recovery of KZT2000000 (USD13605) from editor-in-chief, KZT3000000 (USD20408) from news agency and KZT5000000 (USD34013) from public association"Union of Sport Journalists" as moral damage.

Representative of interests, lawyer of news agency "Kazakhstan Today"and public association "Union of Sport Journalists" Tamara Simakhina has thought that this case was considered with failure to comply with law requirements. Plaintiffs did not execute pretrial settlement of differences. Pretrial claim was not sent to public association"Union of Sport Journalists". Court has not sent summons to defendants and copies of claim statement with attachments.

Next court session presided over judge G.R. Beysenova will be held at 10.00. a.m. on February 15, 2011.
