There was first legal proceeding by suit of Kazakhstan’s Authors Society to host of daily news program “Center” of TV Radio Company “TAN” Sergey Scherbakov and lyric writer Temirlan Tulegenov about protection of honor, dignity and business reputation in Auezov District Court № 2 on September 10, 2010. Plaintiff asks recovery of KZT10000000 (USD68027) as moral damage jointly.
The charges stemmed from “on-line” information by Sergey Scherbakov in daily news program “Center”, where specialist in the sphere of copyrights and allied rights Temirlan Tulegenov touch on issues of activity of Republican Public Association “Kazakhstan’s Authors Society”, relationships with authors and persons, who used work of authors.
Servicemen of Republican Public Association “Kazakhstan’s Authors Society” thought that there was “on-line” information on funds of organization and their usage, mentioned by T. Tulegenov. It discredited honor, dignity and business reputation. Representatives of Television and Radio Company “TAN” tried to solve a problem in pre-trial order, but party of plaintiff did not agree with it.
On September 10, 2010 Temirlan Tulegenov has made an application of documents discovery, related to collection and assignment of funds between authors and summon of bookkeeper of Republican Public Association “Kazakhstan’s Authors Society to court, because representative of plaintiff could not answer for questions of both parties. Both applications were taken by court.
Plaintiff could not explain demanded amount of moral damage.
