Caraganda Regional Court has settled a dispute in case about “Trunk”

On March 20, 2009 Board of Civil Cases of Caraganda Regional Court has considered appeals of LLC “Alem Press” and “Exclusive Service”. It was connected with judgment of Caraganda Inter District Economic Court. Board of Civil Cases of Caraganda Regional Court has satisfied them. The sum of moral damage was changed (from 2 000 000 to 15 000 tenge). But, publication of the refutation was dismissed.
In January 2009 Caraganda Inter District Economic Court has considered case by suit of LLC “Technics” and SC “City Mal” to former founder of the newspaper “Vzglyad”, Director of LLC “Alem Press” Kanat Alpysova about protection of business reputation. The charges stemmed from article “Trunk is in the centre of town”, published in the newspaper on March 26, 2008. The author of article has expressed his opinion, concerning architectural treatment of mall “City Mal”, which was called as “trunk” by Caraganda’s people. He has used surname of one of heads of SC “City Mal” Oleg Sundukovskiy in insulting tone.
On January 18, 2009 Caraganda Inter District Economic Court has rendered judgment by this case. As a result of it newspaper should paid 2 000 000 tenge and published refutation in regional newspaper “Industrialnaya Caraganda” (issue of the newspaper was stopped from January 01, 2009).
Director of SC “City Mal” Oleg Sundukovskiy has made a claim to the newspaper “Vzglyad” in summer 2008. Judge Makasheva has rendered default judgment. Editorial staff should paid 1 000 000 tenge for plaintiff. It was dismissed some times late.
