Picket of journalists for support of the newspaper “Taszhargan” has been without any incidents

There was an action of protest against judgment of City Court in relation to the newspaper “Taszhargan” and journalist Almas Kusherbayev in Almaty on March 10, 2009.
Appeal Instance of Almaty City Court bound newspaper and journalist to pay 30 000 000 tenge (200 000 USD) as damage for Deputy of Majilis of Parliament of the Republic of Kazakhstan Romin Madinov. Proofs of damage were not presented. This judgment was dismissed, because there was lack of money of the newspaper “Taszhargan” and Almas Kusherbayev. Courts of First and Second Instance have presented it in documental version.
Representatives of newspapers such as, “Svoboda slova”, “Taszhargan”, “Zhas Alash”, “Alga”, “Pravda Kazakhstana”, “Kazakhstan”, “Obschestvennaya positsiya”; International Foundation for Protection of Freedom of Speech “Adil soz” and Foundation “Journalisty v bede” have stood before the entrance of City Court. They had mouth bands with note “Fine”. It was done as protest against judgment of the newspaper “Taszhargan”. There were about 200 people have taken participation in action; some of them put murals in their hands.
Police officers did not interfere into organization of the picket. Acting Chairman of Board of Civil Courts of Almaty City Court Raushan Adilbayeva has taken all participants of the action in twenty minutes after beginning of picket. Her speech has been cracked. She has said that organization of non-sanctioned action of protest of journalist could be qualified as pressure upon court.
Raushan Adilbayeva has explained that law forbids expression of opinion by this case before session of supervisory body of the court. It has not been a method of solution of the situation and qualified as pressure upon court. She said that ruling come to law-enforcement and has not been subject to discussion. Adilbayeva has proposed to representatives of the newspaper “Taszhargan” to address to supervisory court instance.
President of the Foundation “Adil soz” Tamara Kaleyeva has said that there was preparation of legal procedural actions by appeal of ruling of appeal instance. It has not been a pressure upon court. The ruling come to law-enforcement and could be discussed and commented in accordance with laws. There was any doubt to keep law. First, there was non-fulfilled judgment and second law could not be improved without discussion and critical comments.
Raushan Adilbayeva has drifted out room, participants of the picket left for place of action. An official letter “Explanation of law”, signed by Deputy for Public Prosecutor of Almaty B. Taimbetov was given to everyone before picket. There will be administrative court and fine for activists of the picket.
