Monitoring of violations of freedom of speech was made in January 2009

Monitoring of Foundation “Adil soz” has registered 80 reports in January 2009. 19 of which define the actual state of mass media in light of the political atmosphere of the month; 41 of which provide information on direct violation of rights of mass media and journalists; 20- on conflicts and charges brought forward against mass media and journalists.
Arrest of the month: On January 06, 2009 he was detained and on December 09, 2008 Yesergepov was arrested as charged person under article 172 “Illegal Obtaining, Divulging of State Secrets” and article 228 “Abuse of Authority”.
Representative Officers of Public Organizations and Independent Mass Media have applied for President of the Republic of Kazakhstan Nursultan Nazarbayev and Public Prosecutor of the Republic of Kazakhstan Rashid Tusupbekov with the open letter at the press conference on January 12, 2009. They have asked for them to change preventive punishment to Ramazan Yesergepov and remove this case to non-interested law-enforcement organ.
Judgment of the month: There was final legal proceeding by suit of the deputy of Majilis of Parliament of the Republic of Kazakhstan Ramin Madinov to the newspaper “Taszhargan”, its chief editor Bakhytgul Makimbay and journalist Almas Kusherbayev in Medeu District Court of Almaty on January 16, 2009. The newspaper has to publish refutation; three millions tenge as damage will be recovered from defendants in joint and several order. Editorial staff is intended to dispute decision in appeal order.

Both parties have come to amicable agreement during legal proceeding. The plaintiff has refused from recovery of the damage. Defendants have said that photo of Karlygash Molbayeva was made without her permission and it was not related to the material, plaintiff as court secretary and title of the article “Sleep, but there is legal proceeding”.
Offence of the month: Inhabitant of Ekibastuz has brought in an action against newspaper “Ekibastuzskoe obozrenie” to court. It was connected with phrase “You will know everything”, published in the newspaper during subscription campaign and it has been untrue. Reader has said that she bought two other newspapers. She did not get any information on important events. There were lots of orthographic and style errors of Russian language in the article. She was unsatisfied by incorrect proof, syllabifications, case of plagiarism and there was no any reference to origin. This woman has asked for editorial staff to publish origins of materials of recreational character, take back all issues, pay the value of annual subscription and recover 10000 tenge as damage.
Prohibition of the month: Vice Premier of the Republic of Kazakhstan Umirzak Shukeyev has said next information, concerning stabilization of real estate market. Shukeyev has said that he prohibited to state officials to make some construction works and give comments. As a result of it some people did not understand anything. Comments will be given by his order or by him.
Issue of the month: There was press-conference for regional mass media on January 28, 2009. Akim of West Kazakhstan region Bakhtykozha Izmuhambetov has answered for questions of journalists, concerning results of last year.
Chief Editor of News Service of Uralsk TV Channel “TDK-42” Lukpan Akhmedyarov has asked for him about participation of his relatives in assimiliation of budgeting funds as in last year. He has meant building company “Monolit-2”, which was headed by son-in-law of regional akim Amanzhol Zinullin.
Akim has answered that he became an akim and that’s why his relatives should not leave for region and they will be his relatives in any case. Amanzhol Zinullin has added that he was not involved in corruption.
After press conference Lukpan Akhmedyarov was called by Director of TV Channel “TDK-42” Serik Mergaliyev. He has twitted him for non-correct question, addressed to akim. Serik Mergaliyev has said that Bakhtykozha Izmuhambetov phoned to him. He has said that Mergaliyev had very serious conversation to him. Director has asked for Lukpan Akhmedyarov to write letter of resignation from his position. Lukpan Akhmedyarov has refused to do it.
Journalist has said that Director of TV Channel has invited staff for saying that Lukpan Akhmedyarov tricked everyone from non-correct question, addressed to akim. This non-correct question discredited business reputation of TV Channel.
Correspondent Sanat Urnaliev was dismissed from Uralsk TV Channel “TDK-42” in September 2008. Urnaliev was dismissed from non-correct questions, addressed to akim of Uralsk Samigolla Urazov.
