Correspondent of Kokshetau newspaper “Kurs” Marina Rybalko is charged of libel

On February 12, 2009 correspondent of the newspaper “Kurs” Marina Rybalko has accepted service to Schusinsk City Court. There was opening a criminal case against Marina Rybalko under article 129 p.2 “Slander which is contained in a public speech, or in a publicly displayed work, or in mass information media” of Criminal Code of the Republic of Kazakhstan by private complaint of T. Plotnikova.

The charges stemmed from article “Does patronage instrument of the profit?” by Madina Mukhamedzhanova (pseudonym of Marina Rybalko).

There was article about inhabitant of Schusinsk T. Plotnikova. She has taken Alisa Gamolko for foster care. Journalist has used evidences for publication of her article. They have said that she picked on a child, did not nurse, dress her, used hard educational measures in relation to her and pushed undressed her outside. There was also a conclusion of the Centre of Psychological Support “Semya”. This girl has cried and asked to return her to the boarding school.

There was fact of illegal withdrawal of money from account (loss of supporter) of Alisa by Plotnikova. Department of Education of Akmola region has bound Plotnikova to return money on account of Alisa.

The legal proceeding by this publication was finished in 2007. Private complaint of T. Plotnikova was dismissed.

In February 2009 heroine of the article Plotnikova has addressed to court with private complaint in relation to Chief Editor of the newspaper “Kurs” Marina Rybalko and evidences in the article of R. Fedotova, A. Zhukova and S. Pashovkina.

The judge has asked for Marina Rybalko to come to amicable agreement. T. Plotnikova and her lawyer have demanded that Marina Rybalko made public apology on first page of the newspaper “Kurs” and found her guilt in libel of Plotnikova. T. Plotnikova wanted to call sum of damage after coming of amicable agreement. Editorial staff had to pay to her.
