Honor not damaged: the court in Almaty dismiss a businessman's claim against Total.kz
In February 2021, a certain A. Mazin filed a claim to the district court No. 2 of the Almaly district of Almaty against Total Media Qazaqstan LLP, the owner of the news website Total.kz.
A. Mazin believed that the article published on January 27, 2016, "False Businessmen Stole Almost 500 Million Tenge from the State," damages his honor, dignity and business reputation. Though the article was based on an official press release issued by the court. The press-released told about two residents of the North Kazakhstan region sentenced for false entrepreneurship.
On March 3, the court left A. Mazin's claim without consideration due to non-compliance with the procedure for pre-trial settlement of the dispute stipulated by law. The ruling of the court on leaving without consideration was appealed by Mazin and on May 26 the Almaty city court canceled it.
On September 2, the Almaly district court No. 2 of the Almaty considered Mazin's claim and threw out a claim.
“This is to reject satisfaction of the claim of Alexander Mazin against the limited liability partnership“ Total Media Qazaqstan ”, Emil Shamsutdinov, Askar Kubayzhanov to acknowledge the article posted on the website“ total.kz ”on January 27, 2016 false and demaging honor, dignity and business reputation, to refute the published information within seven days, to recover compensation for moral damage", the court's decision says.
