"Nasha Gazeta" is under trial again

A resident of Kostanay Asylbek Muldakhmetov appealed the court No. 2 of Kostanay  with a demand to bring criminal charges under Article 130, Part 2 of the Criminal Code of the Republic of Kazakhstan to Olga Kolokolova, editor-in-chief of Nasha Gazeta weekly. He believes that the editor-in-chief has slandered him in Dmitry Petrenko’s article “No one will return my face to me” (“NG” of October 25, 2018).The article tells about a resident of Kostanay I. Bortkova, who underwent several maxillofacial operations. Bortkova blamed the doctor A. Muldahmetova dentistry Dental for the fact that she was hospitalized with a diagnosis of acute osteomyelitis of the jaws. Asylbek Muldakhmetov appealed to the Kostanay city court with a claim for compensation for moral damage in the amount of 3 million tenge because of or the same article. The lawsuit was filed to the editorial team of the media outlet and to  Timur Gafurov, acting editor-in-chief of Nasha Gazeta.

The plaintiff asserts that the editors dissiminated false information discrediting the honor, dignity and business reputation of both Molddhmetova and KAZSTOM LLP, where he works.

According to the editorial team, the entire article was based on the words of Bortkova, the doctor, the director of the clinic and official documents. Information about other victims was voiced in the form of a question to the director of the clinic - that is, the journalist tried to check the reports that were received by the editorial team. The article does not contain this information in the form of a statement or fact.On May 30, the court returned the lawsuit to the plaintiff.
