The claim to Total.kz, NUR.KZ and "Vremya" newspaper is left undecided

On May 27, 2019, the Auezov District Court of Almaty left undecided the claim of T.Mergenbaev and K.Kiltbaeva to the owners of the Internet portals Total.kz, NUR.KZ anf the newspaper “Vremya" D.Khamraeva  and Kh.Maxut on the protection of honor, dignity and business reputation.

The claim was based on a one-year-old publication about the litigation of the partners of an ordinary microloan organization LLP “Reliance credit group”. Plaintiffs, in violation of the requirements of Art. 143 of the Civil Code, did not fulfill the pretrial order of settlement of the dispute, did not present pretrial claims demanding to publish refutations. At the stage of pre-trial hearing the defendants filed applications for leaving the claim undecided due to non-compliance with the mandatory pre-trial procedure for settling the dispute.

The court granted the petition of the defendants, the claim was left undecided and returned to the plaintiffs.
