Timur Davletov aquitted on inciting hatred

22 february 2019

On February 22, the Petropavlovsk City Court acquitted a resident of the city Timur Davletov,  suspected of inciting religious hatred. He is released from the courtroom.

The prosecutor  requested four years of imprisonment for Davletov.

Timur Davletov reposted five posts in the social network Vkontakte . Three of them were sent for expert examination:

- video “On the non-participation of the salufy in the terrorist attack in Aktobe - Sheikh Muhammad ibn Hadiy al-Madhamet. mp4 ";

- audio file "Abdurrahim - ISIS (ISIL) - the enemies of Islam";

- audio file "Nazratullah Abu Ibrahim (Maryam) - Mistaken belief of the terrorist organizations ISIL or ISIS".

An expert of the Institute of Forensic Expertise for the South Kazakhstan region found signs of incitement of religious hatred in those posts. Experts of the Almaty branch of the Forensic Examination Center of the Ministry of Justice of the Republic of Kazakhstan did not find signs of inciting religious hatred in the audio and video files submitted for expert examinaton.  Davletov's lawers  Alexander Zenkovsky and Indira Tlegenova applied to the experts of the Center for Expert Studies on Information Disputes of the Adil Soz Foundation for linguistic advice. Specialists of the center came to the conclusion that the meaning of the texts is warning young, uneducated people against the danger of joining the ISIL group, informing  about the hostile goals of the group and informing that ISIL is not Islam. Court hearings of this case lasted from September 20, 2018.
