The regional court satisfied policeman’s claim to newspaper "Uralskaya Nedelya" again

The appeal board on civil cases of the West Kazakhstan regional court reconsidered the appeal of LLP "Journalistic Initiative" and the editor-in-chief of the "Uralskaya Nedelya" Tamara Eslyamova against the judicial acts issued on the suit of protection of honor, dignity and business reputation filed by police major Daniyar Rakishev.

As it was reported earlier, on August 29, the Supreme Court cancelled court decision of the city court No. 2 of Uralsk dated October 19, 2016 and the decision of the West Kazakhstan regional court dated December 27, 2016 and sent the case to the regional court for reconsideration by another panel of judges.

On October 18, the regional court satisfied Rakishev’s claim and  recognized the information as unreliable and prophesying, and ordered the newspaper to publish a refutation. The court reduced the monetary compensation for moral damage that is to be collected from "Journalistic Initiative" LLP from 2 million tenge to 200 thousand tenge, and to be collected from with T.Eslyamova  - from 1.5 million tenge to 100 thousand tenge.

Defendants intend to appeal this decision to the Supreme Court of the Republic of Kazakhstan.
