The court dismissed the claim of the ex-Head of Public Health Department of South Kazakhstan Region to the newspaper "Caravan" without prejudice

At a court hearing on May 3, the representative of the plaintiff - ex-Head of Public Health Department of South Kazakhstan Region Zhumagali Ismailov - filed a petition to dismiss the claim to the newspaper "Caravan" without prejudice. The court granted the application and the trial, that lasted for almost 5 months, was terminated.

On December 12, 2016 Bostandyk District Court of Almaty allowed Ismailov’s claim to protect honor, dignity and business reputation against editor-in-chief of the newspaper «Caravan» (Almaty) Igor Shakhnovich and journalist Ermek Kasymov. The reason for the suit was publication of articles “Conservation Act of Corruption. How gingerbread man got to Astana (caravan.kz, 14.10.2016.) and «Caravan» made an apology to Beibut Atamkulov» (caravan.kz, 21.10.2016.) on the website of newspaper «Caravan». The plaintiff believes publications contain negative information about his activity and describe him unfavorably from the point of view of observance of laws, moral principles of the society and pointed at formation of negative opinion of readers about him. 

Zhumagali Ismailov demands to declare the information to be false and inaccurate, publish a retraction and remove publications from website of the edition. The plaintiff evaluated moral damage in KZT30000000 and demanded to recover it from defendants jointly.  

On April 11, 2017 Al-Farabi District Court of Shymkent sanctioned pre-trial restraint in the form of arrest. Zhumagali Ismailov is suspected of commercial bribery on a large scale under article 253 p.6 of Criminal Code of the Republic of Kazakhstan and creation of criminal organized group with his malfeasance under article 262 p.3 of Criminal Code of the Republic of Kazakhstan.
